Nursing home negligence is a growing problem in the United States. As the baby boomer population reaches retirement age, and our healthcare systems improve, people are living longer. Many individuals are seeking assisted living or nursing home facilities. These individuals are more vulnerable than others. 

Often times they are not treated well in the care of nursing home or assisted living professionals. Here are some signs that should raise your concern for your loved one:

  • Unexplained Injuries (head injuries, broken bones or sprains, bruises, burn cuts or abrasions)

  • Malnutrition or Dehydration

Because long-term care for the elderly is extremely expensive (well over $5,000 per month), the majority of residents go through their assets in a matter of months and then become eligible for federal Medicaid benefits. This  process is known as “Spending Down”.  Over 90% of nursing home costs are paid by Medicaid. 

Almost all nursing home facilities receive Medicaid funds. Any facilities that accept Medicaid funds must abide by government regulations that set a minimum standard for the care of the residents. The regulations set guidelines for care, treatment, and evaluation of residents care.

This is done with the hopes of maximizing the quality of daily life and minimizing the abuse and neglect.  Unfortunately, this is an increasingly troubling problem. 

Many of these institutions or long-term care facilities are owned by for profit corporations. In an effort to control the costs and maximize their profits, they reduce staff or hired less qualified individuals to care for these residents. Too often, elderly or disabled residents do not receive the attention and care they deserve. Such neglect can lead to disastrous consequences.
